Job summary

The Ministry of Defence employs over 50,000 Civil Servants. Within that, the Army Top Level Budget (TLB) employs around 7,000 MOD Civil Servants located at over 300 locations. Ours is a diverse workforce, with roles ranging from trainers, human resources, teachers, and psychologists to storekeepers, financiers, project and programme managers, and policy secretariat staff. There are many different functions and professions delivering key outputs for the Army.  

The Defence Serious Crime Command (DSCC) is current looking for a Data Protection Authority (DPA) to join our team of civilian and military personnel at Southwick Park, Fareham.

DSCC is a tri-service organisation, and it is the headquarters for the Defence Serious Crime Unit (DSCU) and the Victim Witness Care Unit (VWCU).

The DSCC Data Protection Authority (DPA) is a statutory and independent role within HQ DSCC, sitting within the Information Governance Team.

Job description

The Data Protection Authority is accountable to the provost Marshal (Serious Crime) who is named as a ‘competent authority’ in Schedule 7 of Data Protection Act '18 and therefore the ‘controller’ for determining the purpose and means of processing personal data for law enforcement purposes. PM(SC) has a legal responsibility to ensure compliance with DPA 18, thus the DSCC DPA will provide day to day advice and assurance to PM(SC) that data protection risks are being managed appropriately, along with the provision of strategic advice, planning and compliance with all aspects of data protection, legislation and guidance.

The primary role of the DSCC DPA is to support Provose Marshall and the wider DSCC compliance with data protection legislation, and to ensure that the data subjects’ rights are upheld. Whilst the MOD provides data protection ‘top cover’, this is limited to general processing of personal data covered under Part 2 of the DPA and the UK General Data Protection Regulation (GDPR) regime. Part 3 of the DPA 18 only applies to ‘competent authorities’ (or their processors) processing personal data for law enforcement purposes.

Roles and Responsibilities

  • Ensure that controllers and data subjects are informed about their data protection rights, obligations, and responsibilities and raise awareness about them.
  • Promote adherence to Part 3 of the Data Protection Act, the MOD’s Data Protection policy and other central guidance within the DSCC and Unit.
  • Ensure that all staff within their business areas are aware of their Data Protection responsibilities, including tracking, managing and lessons learned for any data breaches.
  • Advise and assist Information Asset Owners and DSCC and Unit project teams throughout the Data Protection Impact Assessment (DPIA) process, as required. To check the Screening and DPIA Workbook has been completed as required. To confirm if a DPIA is necessary at Screening stage.
  • Reviewing all active DPIAs at least annually.
  • Create, update, and maintain data protection related policies, including privacy impact statements, data sharing, data processing, review, and retention.
  • Implement and/or review the arrangements concerning rectification and deletion of personal information. This should be done in accordance with the Management of Policing In-formation Guidelines, MOD’s Retention and Destruction Schedules, JSPs, Data Protection guidance notes, etc.

Person specification

Essential Requirements:

  • Knowledge of data protection and related policies.
  • Experience of practical implementation of policy, ideally data protection and/or law enforcement.
  • Experience of engaging with stakeholders to resolve business issues and ensure effective and efficient delivery of services.
  • Experience of being organised with excellent planning skills, ability to prioritise and manage your workload

Desirable Requirements:

  • Recent experience of managing data protection and information rights functions within a government department, large organisation, law enforcement body or comparable environment, where the processing of personal data was complex or had identifiable risks.
  • Knowledge and understanding DPA 2018 and GDPR UK.
  • A basic understanding of the Service Police and DSCC role within the Service Justice System (SJS).
  •  Experience and knowledge of existing working practices within government, including risk management, data privacy impact assessment, governance, and compliance
  •  Qualified to CIPP/E or Certified Data Protection Practitioner (PC.dp) or BCS Practitioner Certificate in Data Protection (DPA2018 & GDPR).

Where business needs allow, some roles may be suitable for a combination of office and home-based working.  This is a non-contractual arrangement where all office-based employees will be expected to spend a minimum of 60% of their working time in office, subject to capacity and any required workplace adjustments. Requirements to attend other locations for official business, or work in another MOD office, will also count towards this level of attendance.
